I've been thinking about this and the only way they would really have any legal case is if that guy buys directed from Cryptozoic. I have two cases sitting next to me that I bought from a 3rd party and there is nothing on them that says "Do not open or sell until Dec 11th." I'm not going to list them out of respect for the company but I just don't see what they could possibly do to a consumer on the retail level.
