There was a case awhile ago where someone received several thousand in silver coins by mistake. They refused to return and they ended up arrested.
The law was made to prevent companies from sending you a product then a bill. Something sent by mistake is not protected by the gift law.
No idea if it would be mail fraud or some other law but the guy legally isn't allowed to keep it. That being said I doubt any government agency would pursue it.
