They wouldn't even have to go that far. Just a photo of each card with it's number (1/99, 2/99, etc). You go look up a set, subset, and the number of the card and see it with its original swatch/patch.

They put out fake patches,so why would they care if someone else does after the item has been purchased ?

I totally agree. Topps does not want to do this because they might actually have to acquire an actual game used jersey/bat to use in their products!,!
