What can I do about someone saying the card wasn't in the package

OP, sorry you had to go through this situation, and I hope paypal rules (rightfully) in your favor.

But I just wanted to add that between this, FCB, and HK, this situation has been both one of the most well researched and one of the most hilarious cases of scamming that I have ever read on card forums. A guy tried to pull a few scams (empty mailers + shilling) and forgot that the internet remembers everything. Justice is a wonderful thing.

Let me preface this by saying that I am in no way trying to take one side or the other. This is a lousy situation for the the seller and can totally relate.

I am on FCB as well. Same name as on here. I had one deal with Nick1190 on FCB. I bought a nice Stamkos Cup Patch Auto from him for $115. I gifted the payment to him (lesson learned), and it took a little over a month to get the card from him. He told me a few times he was having medical issues, and that I would get my card. I was seriously having my doubts that I would get the card. Finally I got it from him. I have no idea if I was going to be scammed by him or not. Glad I wasn't.

I know a few others have had deals with him in the past, and he came through for them as well. I am not trying to vouch for him, as this looks really bad. I just wanted to share my experience with my dealings with Nick.

exactly, I had a package that I had with delivery confirmation and insured at $325. The buyer (who I made a thread about as well) claimed that the package only had a stack of base cards instead of the high valued cards I sent. There was nothing I could do as Ebay still gave the decision to him despite all my proof and best efforts against the scammer

I have both on both sides of this fence. It sucks to have to be questioned about it. Ebay sellers have to start leaving feedback again. Until then these types of situations will never stop.

This happened to me once. I didn't buy insurance and ebay/paypal gave the buyer a refund from my paypal balance and locked my account until the case was resolved. If you don't purchase the insurance you are screwed unfortunately.

I'm not sure, there seems to be a good amount of outside evidence which supports an attempted scam.

No card but the case is on hold. Its kinda strange this is the reason they said:

eBay Customer Support comments:
We asked the buyer to provide written confirmation from the manufacturer or law enforcement that the item is counterfeit.

I dont understand why he would have told them it was counterfeit if it was never received it. Very interesting

I once received a mailer with a different card in it. The guy called me a scammer and a liar and a thief. Few months later he's selling the same card again. Ebay did NOTHING about him. I got my money back except I had to pay for express shipping back to him, so I lost about $50. Once again, ebay did NOTHING. That was one of my final straws with them.
