Iron Patriot in Iron Man 3 may NOT be Iron Patriot afterall
Rumors from rumor places suggest that that pic of Iron Patriot from the Iron Man 3 set is not Iron Patriot at all, but War Machine with a new paint job, and the white dude piloting it was not the bad guy played by James Dale but a stuntman standing in for Don Cheadle. I find this reasonable, but I don't find the original explanation unreasonable, so I'll await more official confirmation.

as much as i would like to think it is war machine my money is that it is the iron patriot just with all the avengers stuff going on now and since he was a part of the dark avengers and all. but we will have to see

I think It is War machine, not Iron Patriot.
Don CHeadler is specifically called Rhody/War machine on IMDB That would be from the script Glad I sold mine already is all I have to say

Not a fan of the new Iron Man suit, too much gold, looks tacky
