hate to hear it but NOTHING you can do. i bought a team signed helmet and the seller sent me a case keenum helmet and my helmet went to the other guy. guess what he kept it! i sent the seller back the helmet and he did send a psa/dna pat white 8x10 but i wanted my wvu team signed helmet. karma is a mother and you should always do the right thing

Sorry that guy is being a dick. You kinda have chalk this one up as an expensive learning experience. I had someone send me the card I bought, and then, by mistake sent me another card right after that they had sold to someone else (a bowman chrome red refractor auto). I sent it back because (a) it's the right thing to do and (b) I didn't want the bad karma. They hooked me up with a refund on the card I did buy. I've also been burnt on a trade where I sent cards and the other person sent me an emply top loader. Some people just like to ruin things for everyone else...

Yeah I agree with everyone, you are pretty much SOL. One time I accidentally sent someone $100 bill along with their card, luckily for me, the buyer was honest and actually sent it back. Anyways, good luck man...

i did the same thing. sold a $52 seaver auto i had to go away. called home told them to send it. then sent the quotable insted. the guy refused to respond back to all of my emials.

This is really a crappy situation for you. Just an FYI though, whenever you sell an for over $250 you have to send it with "Signature Confirmation" in order to be covered under Paypal's Seller Protection. I actually use it on all items over $100 just to cover my rear end.

I agree, not mail fraud, just a bad mistake.
Honestly, the only thing I could see if he never returns it is filing a civil suit. Of course, here in Florida filing a civil suit costs $250, so... that seems fairly pointless. I would definitely beg the guy with every sad story I have, because if I lost $350 bucks refunding the other guy, I'd be done for. If it's never resolved in your favor, I do believe that you would be able to deduct this bad transaction from your income taxes depending on your personal/business tax situation.

There was a case awhile ago where someone received several thousand in silver coins by mistake. They refused to return and they ended up arrested.
The law was made to prevent companies from sending you a product then a bill. Something sent by mistake is not protected by the gift law. No idea if it would be mail fraud or some other law but the guy legally isn't allowed to keep it. That being said I doubt any government agency would pursue it. |

I think you are SOL there is also a law that states if you receive something in the mail and you didn't order it you are not required to send it back. You addressed the package to him and he didn't commit mail fraud just by receiving the package. I would check with your local police but I doubt you have a case to get the card back. Sorry!
