Buyer won 34 Kevin Garnett cards from me including rare rookies Electric Court Gold, SE Gold, many others. Initially said was going to pay immediately so I sent an invoice with a discount on the total expecting prompt payment. He then took 6 days to pay.

I sent registered post AUS - USA.

Later received a message to say he was missing 3 cards and wanted $15 paypal to sort it out.
I refused as I had checked off the cards as I went as I always do.

Buyer then lodges a claim for 5 missing cards totalling $77+ "not as described"

Paypal grant refund providing "remaining" cards are returned to seller (me).


Today I get the return package and it is full of base cards.

I filmed it and have appealed the decision and will advise, just wanted to let people know the user name on ebay.

eBay information is a PO Box for Newport News, VA and this is the same in paypal case. I am asking if a PO Box is satisfactory as a verified address?

I did a buyer info request through ebay and it gave me a phone number in Tallahassee, FL but no address.

On the 4th appeal someone said for me to get a police event number based on the fact "buyer returned wrong item".

I did this, the NSW Police faxed them the details.

Paypal last night AGAIN denied the appeal, and reverted back to the reasoning given on the first appeal.

I have lodged a report with the ACCC (Aust Competition & Consumer Commision) and given details to ScamWatch.

This is unacceptable!

eBay suspended my account for feedback violation - ah well, was gonna close it anyway

Response from FOS - following up claim with paypal, paypal receives a fine either way.

Omg. This is part of the reason why I NEVER ship international. I know it can happen in the US also. But much much easier to track a person down if needed.

yeah ebay removed some of my feedbacks stating negative words in a positive rating etc etc, some were removed within the hour. I have left some more which were edited and some remain. It's ridiculous that no negatives can be left for buyers.

Today I filed a police report and faxed it to paypal, something they only informed me of after 4 appeals!
Hopefully this will be satisfactory and they will now reverse the decision!

Paypal again denied my claim. Even after I provided them with the Police Incident report number stating "buyer returned wrong item".

It is an absolute joke.

Wonder if you can sue paypal...seems like they always rule in favor of buyer...also wonder if this buyer has a history of doing this.....thiefs are greedy and would not stop at 1 scam must be others before you...he is playing the system so he has knowledge what he can get away with

I'm reporting all the info to the ACCC (consumer and competition commission in Australia) as it it's totally ridiculous that they side with the buyer after I have provided all this evidence.

If this buyer hasn't got a history of running the same scam over and over again they will probably start now that they know they can get away with it.

I have got a lot of responses of concern on HK, is noone on blowout concerned about this loophole? Pretty shocked compared to how many members there are on here!

ebay is a joke!! got the shaft by a seller....was shorted several cards, opened a case, was advised by ebay to use their shipping label and once it showed delivered they would refund. Seller wrote on box return to sender and ebay closed case stating since nothing was retuned that it must have been settled and closed the case!!!

I'd be calling Ebay real quick on that one. A seller can't get out of a refund by refusing the return. Otherwise all returns would get refused. Hope you can still leave feedback.

I don't think buyers OR sellers are protected on ebay by paypal.
If someone wants to scam you, they will, it's virtually up to people's morals not to. I think I was lucky to have such a good run up to this point.

ebay cannot have it that sellers cannot leave negative feedback for buyers, it's not accurate. They have to sort out the retaliatory feedback rather than just make it positive only, it's ridiculous!

ebay should not have been able to buy paypal in the first place! It's a monopoly! It's anti-competitive! Amazingly stupid!
