Angry Double Jeopardy with Paypal.

So I started a thread the other day about "am i gonna get screwed" and before I could cancel that thread, my, the "buyer's" claim was closed. Now, as of this morning, the "buyer" of this card, 260597281630, has filed an appeal stating that the item was significantly not as described.

So, first the buyer says, "I never received my item". I provide a tracking/insurance number and I printed my shipping label through Paypal. The tracking status on USPS.com stated the item was "delivered". I won the claim in like 5 minutes. Now, the buyer says, "I have received the item but it is not as described".

Am I gonna get screwed?

Yes. Paypal almost always sides with the buyer. I'm beyond sick and tired of both Paypal/Ebay.

This is one of the huge glitches in the Ebay system. Sux... sorry.

I had some jacka$$ overseas try that same thing. Paypal ruled in his favor after the 2nd one,BUT I was able to appeal that decision and was credited back the $$ from paypal after they reviewed my history on both ebay and paypal

Not necessarily, the "buyer" will have to submit a statement as to why they belive that the card is "significantly different" than described in the auction. Looking at the auction page, there is really no grey area unless you shipped him a completely different card. If anything, when you are asked to reply to the "buyer's" account of the problem, it should be mentioned that the person is obviously attempting to defraud you and receive the merchandise for free and should not be allowed to leave feedback/DSR's that could damage your rating.

I've had a problem before where I received an item that was significantly not as described and filed a claim to get a refund. While it is usually the case that ebay/paypal will side with the buyer on these claims, in my experience the buyer ALWAYS has to return the item in the same condition it was received in in order to receive a refund. The buyer must also provide tracking information to ebay/paypal to confirm returning it.

So worst case, you get your item back and they get their money back. I've never heard of paypal/ebay refunding an "item not as described" case without having the item returned first.

Texans81 is correct, PayPal/Ebay will require the buyer to send the item back to you before they will issue a refund. However, they may put a "hold" on the money in your PayPal account (for the amount in dispute) so that you do not empty your account.

Any way you slice it though, they are much more willing to believe the buyer over the seller which is odd since the sellers pay most of the fees...

I had someone do a SNAD on me. They had to return the item in the original condition but they sent me a bunch of random proset garbage back. I appealed to paypal but they said "There was no way to prove that I had sent the original item."

If it comes down to the buyer having to return the item then I guess I'll have to set up the video camera. Record the postman delivering the item, me taking the package out of the mail box, showing who the item is from(buyer), opening the package and revealing the content. I think this would cover me ars.

Sad that it's come to this, but yeah that would probably be a good idea.
