I have a claim open, but i think for the second time on BO (basically 0 on other sites not named ebay in over 1000 deals) i am going to get taken for my money

Specifics would help.

If you have a claim open you should prevail of you did not receive what you paid for.

I bought a lot from him about 2 weeks ago and he admitted he did not send. He said on the 31st hed get me a refund by the 1st. nothing happened. i have a claim open on paypal, but i can only get back whatever is in his account, correct?

No you should be able to get the whole amount back. Did you pay via balance or Credit Card? He will need to respond to the claim and if he does not provide delivery confirmation you should get refunded

It won't make any kind of difference IMO because if he didnt respond to your inquiries now, what makes you think it won't get dragged out anyway. I would just leavre him a neg. now so that others will have a heads up about him right away. Face it you have a claim and he is a dbag so I hope you win and good luck.

Leave the neg. though to protect others. Just my two cents.
