Default Issue with a member over a deal.

I'm not going to name names (yet?). That is not what this is about (yet?). Basically he has a DC # confirming delivery almost a week ago. I have never received the card. He refuses to give me a refund. I even told him if it does show up I will immediately give him his damn $15 back. He refuses still. I told him I will be taking it up with paypal and he responds "Cool... my proof of tracking/delivery is all I need to win the case, I already contacted them regarding this issue... But go ahead."

So the member is basically calling me a liar. This amazes me. Yes, I am going to lie, over a $15 deal. Please.

So is that it? Paypal will see his DC # and rule in his favor?

Do you have the DC number? If so, look at the tracking info and where it ended up. If its your town, you may need to go down to the PO and check on it. The driver may have scanned it and dropped it between his seat or even dropped it at a neighbors house.

I've talked to my driver and the local post office. They do not know where the package is.

Ask the seller if he bought insurance. If not, then he will most likely have to take the loss if you didn't receive the package. At least I would think that would be the case?

Joe, he told me he will not take the loss and that paypal already told him they would side with him and his DC number.

He won't have any choice but to take the loss if you in fact did not receive.

Well if we ain't callin anyone out, this thread is pointless. So until we have someone to baste, I will give this thread some substance:

Why do farts smell worse in the shower?

Feel free to post answers or experiences until get a name....then we can get back to the normally scheduled program.

It says delivered in the USPS tracking system so did you check with your neighbors? Mail gets put into the wrong mailbox all the time...

I am not a rookie in this game. I have exhausted every avenue needed before bringing this up.

Of note, the card in question is this Demarco Murray card:

2011 BOWMAN STERLING DEMARCO MURRAY GOLD REFRACTOR PATCH /25 RARE SP | eBay

Seller had it in his quick sale thread for $13. I immediately snatched it up. Seller then had remorse and realized the card was worth more. This may play into the situation, it may not.

I still don't know who the seller is, but this is looking like a situation of f'ed up mail delivery. Not exactly fault of the seller, unless he had an elaborate plan to ship the card to a friend in the same town as you.

Hard situation to be in really. Its he said he said. PayPal will rule with the seller I have no doubt and there really isn't much I can do either for the same reason that PayPal has.

Ok so the only other possibility is he sent a package, containing who knows what, to an address in your city with a DC# so he could say he sent it. Is there any way to get the exact address he sent to from USPS?

Awesome. I would think my feedback here would stand for something.

Guess I am out $15. Can't even leave him a negative here? I know if it was me in his shoes I would immediately issue a refund.

I had not thought of that. You are onto something. It only shows Round Rock and I don't believe you can find out exactly what address was on the package.

Yeah its happened to me in the past on other forums so Ive figured out ways that people can rip each other off.

If there is a DC# showing "Delivered" to your zip code, then you will lose the PayPal case. Further, if the seller used PayPal shipping, then PayPal would know if they shipped to your PayPal registered address because the transaction in the sellers PayPal account would show your address as the one being shipped to. You will lose the PayPal case.

If you were the seller, wouldn't you want PayPal to side with you as well? I mean a DC# showing delivery, what else can a seller do? How does the seller know you aren't trying to rip him/her off?

That being said, there is a "zip code scam", where a seller will use the PO for shipping and get a DC#, ship something to the same zip code as the buyer, and having given that DC# to PayPal, they would win the claim of item not received. But would a seller do that over a $15 item?

Most likely the USPS delivery man f'd up. It happens.

You have great feedback and are a well-standing member on this forum. If I was the seller I'd suggest a split the loss half-half kind of deal, and refund you $7.50. I'd take your word that it didn't arrive, even though the DC# says it did, and hope it didn't happen again.

Its not a matter of feedback. Its a matter of there is just nothing I can do. He has his "proof" that it was delivered. You have your word that it didn't show up at your place. How the hell can I rule one way or the other? It is an impossible spot for me to judge.

I get what you are saying sir. I find it funny you typed out proof in quotations. I also wonder how much positive feedback a member would need to get before a moderator would be able to take his word for something.

thats a damn shame, nice card to. i hope the seller wouldnt do that, but the way things have been lately it wouldnt surprise me either.

Ask seller if he made the label through paypal shipping.
Or you can check in your paypal and you will probably be able to tell.

If he did then it show's delivered. What do you expect the seller to do? His tracking showed delivered.

Maybe the carrier transposed the numbers while delivering.

I get 3-5 items a year that are not addressed to me. Usually when a sub carrier is involved but it does happes.

It's pretty arrogant to think seller should refund because that is what YOU would do. I would probably do the same thing but you can't expect people to do things your way.

Get off your damn high feedback horse. I'm the same guy I was with 5 feedback as I am nearing 200. A number is nothing more than a number. The seller sent a package which was probably misdelivered by the USPS. #@#@#@#@ happens. Good for you if you'd refund the $15. The seller is not obligated to do so, but I would if I were him just to shut you up.
