Default Question about how to proceed

I've been on Blowout for 6 months or so and this is the first problem I've had and I'm looking for some advice on what I should do.

On January 24th, I responded to a sales thread by member robertr1105 for a Jose Fernandez chrome auto refractor for $40(a great price). The thread said he needed Paypal fast and he would ship "as soon as he could."

I paid right away and asked him to let me know when he ships. On the 26th, he PM'd me and said "Sorry for the delay. The Fernandez will go out on Monday." Again I told him that's fine and to let me know the tracking when he ships.

On the 31st, after receiving nothing and hearing nothing, I PM'd him to ask if it has been sent and asked for tracking. No response, but he also hadn't been online for a few days.

On the 4th of February, I saw that he came online but he didn't answer my PM so I decided to PM him again and once again asked if he had shipped it and what was the tracking number. I told him I needed to hear from him ASAP.

He hasn't been online since the 4th. Today is obviously the 6th and I still haven't received anything and haven't heard from him since Jan 26th.

My question is what should I do? Is it time to file a Paypal claim? Is a neg in order here? He has an Itrader of 24 with 100% positive so it's odd. I've obviously never neg'd anyone here and I don't want to if people don't think it's deserved. However, I also don't want this guy having perfect feedback if he's a scammer and using that feedback rating to lure other people.

Opinions?

Paypal claim for sure.

I'd send 1 more PM and give him until the end of the week. If no reply and explanation - Negative.

For US to US shipping 5 to 7 business days is plenty of time. I personally give 15 business days to Canada before I question.

Paypal claim for sure. Once the claim goes through and you get your refund, slap a neg if nothing is recieved or communicated. You have done more than enough from your part in terms of communication.

Alright, I opened a dispute on Paypal. Do you guys automatically escalate it to a claim or do you give the seller a couple of days to respond?

Again, thanks for the help. This is something I haven't had to deal with yet so I'm very interested in the advice of people who have been through it.

Well many people have had 100% itrader then went on to be scanners, you can't trust anyone

at most, give him 24 hours to voluntarily refund.
Considering the length of time youve been waiting, it seems unlikely that you will get a refund without having to escalate.

Drop a neg on him now.

I'm not saying he did a scam with the donation thing, but recent actions cast suspicion. A screenshot is not proof of anything.

I can give you a list of traders you can trust if you like. There is alot of great members on here. You just have to know who they are.

Well, an hour ago I got an email from his dad and he apologized and said his son forgot to ship it. He told me it was mailed yesterday. I immediately emailed him and asked for a tracking number. No response.

Last update. I got the card today. Exactly 2 weeks after I paid for it. To the seller's credit, it was shipped on the 5th and I opened the claim on the 6th, so it wasn't shipped as a response to the claim.

My question is, what kind of feedback should I leave? Positive because I got the card? It was late and the communication was terrible but I did get it. Neutral? Negative?

I'm thinking negative is too harsh because he wasn't a scammer but I'll leave it to the experts.

LMK the feedback I should leave and again, thanks for everyone who helped on this thread.

You cant leave a neg, you got the card. I personally would leave positive because you did get the card, but I would think neutral would be considered acceptable by most.

He said it was shipped prior to the claim being filed, its a different story if he only ships because of the claim.

Just my opinion, but if you can't ship then don't take payment. There's no reason it should take more than 1 business day to ship out.
