Default Does this warrant a NEGATIVE?

Here's the timeline (sorry if this seems in the future since the different time zones)

1/19
Bought and paid for card from member on here

2/22
Waited a bit over a month. No card. So I sent PM and got this reply

Negative, hes hoping he wins. Call paypal ASAP and send them the emails.

If he was going to refund you, he can via the claim. So why wouldn't he now?

Wow, that's kind of messed up. He has the option to refund and close the paypal dispute. If he is choosing not to issue the refund after agreeing to issue a refund, then that is a major red flag in my opinion.

He should have gave you the refund as soon as he left the first message, no reason for him prolonging the transaction! Does he have high feedback and is this a higher end or lower end deal?

Sorry about the questions, I just hate seeing this kind of stuff go on man

There's no probably about it, in my opinion. He definitely deserves a negative.

If he tried to resolve the situation (by giving you a refund ASAP), then I'd probably forgive him for forgetting to post the card. But the two things coupled together do not sit well, and I would feel obliged to warn others about him.

It's a shame to hear it's someone with lots of positive feedback. Hopefully it's just a one off blip.

I'm with everyone else. Negative and name. Life happens and if it was a family emergency I suppose a memory lapse could happen but to just have forgotten....sounds fishy. Negative is very much in order.

Negative immediately - and name for everyone.

Nothing he says matters after he said "I can't find it" after agreeing to sending you a refund. That means he just got caught up in his own lies and forgot whether he was supposed to refund you or send you your card late.

No one should "let the paypal claim happen" if they are aware they didn't send your card - and this person admitted they didn't send it.

I think I understand what he means. He used up the paypal that you sent and now he doesn't have enough to refund you without his balance becoming negative. He currently doesn't have the money to make up for the negative balance? I think that paypal automatically puts your account on "limited access" once you get a negative balance too.

Is this a higher end transaction? if you don't mind me asking, I hope that it's not

he had a pretty easy time spend the $70 I sent him - just puzzles me how his PP is not connected to a CC or his bank account

do everyone a favor and give the name so other people don't get ripped off the some way; ones that don't have 70 to lose.

Okay, it's good to know that it is not a really high end deal. The seller is probably having some financial difficulties at the moment and he didn't want to issue a refund without having the $70 available. By opening the claim, it automatically puts his account in negative (assuming that he doesn't have enough) and I think that a negative balance automatically puts your paypal account in "limited access" mode (meaning that he cannot buy or sell until the negative balance is resolved)

I hope you guys can sort this mess out, I am still a bit confused about him "forgetting" to send the card. When a guy pays me promptly, it's only fair that I send his cards right away. Him forgetting to send tells me that he obviously didn't have the buyer's best interest in mind. How did the guy lose the card? Please don't ask me!

Let us know how everything goes my friend, hopefully he can get back on his feet and you can get back your $70.

So, he spent your money before so much as an intention of sending you the cards? Lots of lies and irresponsibility. Let the Paypal case run it's course, let them put his account in the red (which should hurt quite a bit), then neg him. Oh, and post his name here because, quite frankly, he deserves it.

haha yeh true, you are 100% right and $70 is a lot to me too.

i suppose my response was to put into perspective that it is not a "higher end" transaction (i know i know high end could mean different things to different people. but i am sure the majority of people in this hobby wouldn't regard $70 as high end - especially a bill russell, lebron and MJ collector to whom I was responding to)

$70 is a lot for most of us here! I am just glad that it wasn't a deal where crackberry would have $400 or $500 tied up in a paypal dispute. That's good money that could go towards more cards my man!
