Default How long do you give a seller?

Quick details.

Person posted a thread and I bought a few cards on 10/23. Payment info, and payment were sent same day. I have received nothing so on 11/4 I sent a message asking if they had shipped. Seller had not responded. I checked paypal, tracking isn't in there. Seller has 189 feedback (99.5%) with the one neg saying he never shipped the cards. He has not posted since 10/28 when he was trying desperately to move a higher dollar lot.

File now? Wait a bit longer?

UPDATE 11/7: Seller sent a refund...via echeck...which won't clear until 11/13/13. Along with it was this message:

Patience my friend. Your package did ship w/o DC 2 days after you paid. If you get the cards please return them. I hope there not in you possession and you're just working the system. Refund has been issued.

File and neg. That is more than long enough. 48 hours would have been adequate. From the 23rd to 28th cards should have been shipped so even if something happened to him on the 29th that would not cover him.

You know what this thread needs? The name of the seller. Say cheese fishdaddy If the dude just communicated with you, perhaps this all could had been avoided. Right, fishdaddy?

Absolutely. I have no issue waiting, if I'm kept in the loop.

This is the second neg I've left in a short amount of time. Ironic thing? On the other negative, I gave the guy a MONTH to find the missing card in the lot. He never responded once. I left the neg, and received a message LESS THAN ONE HOUR AFTER wanting to get rid of the neg. After a very thoughtful response, he messages back again the next day still wanting the feedback revised and then another message two days after.

If only he was that on top of it before the negative was dropped...

just left my first neg tonight,
i almost felt bad but then remembered the guy screwed my out of $40, so i feel pretty good.
