Default Vent time

Hey all. I have decided to leave my wife after being with her for 7 years and married for 4.

We have a 2 year old that I plan on taking care of without a question.

My father recently passed and I was left a nice chunk of change from his estate.

I told my soon to be ex that I would put a nice piece of it away into a trust so he can have it when he goes to college. Knowing fully well that she is not privy to any of this money, she has the balls to tell me she wants more of something that she is not entitled to.......

I already spoke to the attorney that is handling the estate and he told me it is my money and only my money.......No need to talk to another one lol

He's not your attorney, right? Ask him if it will impact your upcoming divorce settlement. My guess is he'll give you the same advice KaMD and I did.

Or just ignore it and trust everything will work out fine. Always does in divorces.

Technically he is my attorney because im paying for 1/3 of his services. 1/3 my fathers wife and 1/3 my brother. When I told him about my divorce and that I was opening an account for my son he immediately stopped me in my tracks and said I didnt have to do that and I said I wanted to.

Just found this also

When two people divorce, the issue sometimes arises whether one party may claim rights to another party's inheritance funds acquired during the marriage. Let's say, for example, your great aunt dies and leaves you the assets to her estate in her will with no mention of your spouse (although she knew you were married). This is considered an inheritance acquired during the marriage, and what you do with the assets upon receipt may influence whether you'll have to part with a portion of those assets upon divorce.

Generally, inheritances are not subject to equitable distribution because, by law, inheritances are not considered marital property. Instead, inheritances are treated as separate property belonging to the person who received the inheritance, and therefore may not be divided between the parties in a divorce.
